If a Muslim refrains or stops from declaring an apostate, who claims to be Muslim, an infidel, due to his ignorance of the rulings of apostasy (its conditions, pillars, and impediments), and he fears to hasten in issuing a ruling of infidelity upon someone who claims to be Muslim, while that person denies, detests, and disavows the act of infidelity committed by this person, then this ignorant Muslim will not have entered into the rule (Whoever does not declare the infidel an infidel, he is an infidel). This is because this ignorant Muslim has not rejected any of the religious texts, but rather, has he become an infidel by this act, with the fulfillment of the conditions and pillars and the absence of impediments? Or has Islam remained with him due to the non-fulfillment of the conditions and pillars or the presence of an impediment?

It is clear from the foregoing that: 1. The perpetrator of infidelity who claims to be Muslim is not always an infidel, but rather he has states. He may be an infidel apostate if the conditions and pillars of apostasy are met and its impediments are absent, and he may not leave the religion of Islam by his act of infidelity due to the non-fulfillment of the conditions or pillars or the presence of an impediment to apostasy.

The abstention of a Muslim (who is interpreting or ignorant of the rulings of apostasy) from declaring an apostate, who claims to be Muslim, an infidel, does not necessarily mean that this abstention is a rejection of the religious ruling or a denial of it. Rather, it may be due to the news not reaching him, or that he has not heard those texts, or he heard them but they were not established with him, or another counter-argument contradicted them with him, so he was forced to interpret them. He may be mistaken in this interpretation, and this ignorance or interpretation is a considered excuse in Islamic law for the non-infidelity of this ignorant or interpretive Muslim. Allah Almighty said: "And Allah would not have caused a people to go astray after He had guided them until He made clear to them what they should avoid. Indeed, Allah is Knowing of all things." [Surah At-Tawbah: 115]
