And to clarify for you what we are asking of you with clear text upon which we rely, what do you say, may God be pleased with you, about a man who married a virgin daughter, knowing her virginity, and consummated the marriage with her and enjoyed her for a long time, then she agreed to the removal of her virginity before the judge, and he enjoyed that, and the judge suspended her maintenance for that reason. Then she left his house, and hardship befell her, and she brought her case before the judge, and she offered herself for obedience, and said, "Send for him, for I will obey him in all that he wants." The judge sent this to the judge who suspended her maintenance and said to him, "The man's wife has agreed to what he wants from her regarding the loss of virginity and other things." He refused to attend and did not come to me, and wrote to us a second letter refusing and not attending. After all this, you blame us for a month. If he did not attend during that time, we would have brought witnesses to testify that he left nothing for her. So we brought witnesses, and they testified, and we made her swear according to the words of the witnesses. Therefore, I ruled for her divorce and set a time for it. Then he came after she had completed her waiting period, and we allowed him to present his argument, and I did not accept it. She said to him, "You have your argument." He said to her, "It is my argument." So I upheld the ruling against him. The woman got married while he was present and watching, and she did not leave until she gave birth to children after three years. Now he has come and made a claim, and they have ruled to give her to the first husband and prevent the second. Their reasoning is that a virgin has no maintenance, even if ten years have passed with her husband, because our master Khalil said, "The choice is left to the couple, as long as prior knowledge or consent or enjoyment has not occurred." This ruling has been made, and similarly, maintenance. He sent to her, and he is capable of returning it, and he understood when he said it, and she was expelled without permission and was not able to return it. When he read his answer, I agreed with him on her divorce, and these people prevented him from it. It is narrated that the scholar Uthman bin Halima, his sister, known as Sayyid al-Ruwaykiba, said to the scholar Hamad, "You have not given me anything." He said to him, "I have given you this," and threw a handful of dust at him. He took it from him, and people benefited from that dust, alive and dead, and it became a cure for all ailments, and its benefit spread throughout the lands and cities. He left behind for his children verses to write for the price, so whoever drinks them will be healed by his blessing. Al-Nihaysi carried the matter from Sheikh Taj al-Din al-Bahadi, and he is one of the imams whom Sheikh Hassan sought for the path, and he taught people the Quran for a long time. He had a hand and a position with Sheikh Ajib, and he fought with him and was killed in Karkoukh in the fighting of the Thanj. Sheikh Aib built the mosque that is now there for him and endowed a house for it. He was born in Jazirat Aslayj, and after him, he taught.
