Chapter One Rules for the Principle: "He who does not declare the disbeliever a disbeliever is a disbeliever."

Know, my beloved brother, that the principle "He who does not declare the disbeliever a disbeliever is a disbeliever" is not absolute. Rather, it must have controls, otherwise, you will fall into declaring Muslims disbelievers without legal evidence. This principle is not explicitly stated in the Book and the Sunnah, but scholars have derived it from verses indicating the disbelief of those who deny and reject the texts of Sharia.

As Allah Almighty says: "And when they are told to believe as the people believe, they say: 'Shall we believe as the fools believe?' Verily, they are the fools, but they know not." (Surah Al-Baqarah: 13).

And His saying, may He be glorified: "And when they are told to believe as the people believe, they say: 'Shall we believe as the fools believe?' Verily, they are the fools, but they know not." (Surah Luqman: 32).

And scholars meant by this principle that: He who does not declare a disbeliever to be a disbeliever, whose disbelief is indicated by the legal texts and whose disbelief is known from the religion by necessity, then he is a disbeliever, because he has denied the legal text concerning the disbelief of this disbeliever.

As for one who: * Does not declare the doer of disbelief to be a disbeliever because he was unaware of his situation and did not know of his disbelief. * Or does not declare the doer of disbelief to be a disbeliever because he was unaware of the legal ruling for this action, as in rulings that only scholars know, and he did not know that this action constitutes disbelief, and therefore did not declare the doer of this disbelief to be a disbeliever. * Or he did not declare the doer of disbelief to be a disbeliever because he was unaware of the legal ruling for the doer, thinking that the doer is excused due to ignorance, or that he has an impediment from the impediments of apostasy.
