The Ta'aisha had brought Sheikh Al-Hussein from his homeland in Al-Muzaira and entrusted him with giving lessons in the sciences of Hadith and inheritance in the mosque. When the Qadi Ahmed bin Ali was arrested, he appointed him as Qadi in his place.
When he was appointed Qadi, he said to his companions: "I do not want worldly life, but I want to stand by the Sharia, and whatever I do not have knowledge of, I will only speak the truth about it. I do not think the consequence of that will be death."
And when he was appointed Qadi, a case was presented to him, which was: "A man from the wealthy, named Awad Al-Karim, from the Atama tribe of Berber, who had left his home and settled in the desert, was accused of disbelief and the obligation to confiscate his property." So Sheikh Al-Hussein said: "Do not try to confiscate his property."
And on one day, he summoned him along with his two Qadis, Hussein Jazou and Hamdan, both of whom were from the people of the western region, who knew nothing of the Sharia rulings. They were among the greatest scholars of ignorance and falsehood, and a source of examples. He said to the Ta'aisha: "O Qadis, I have heard the Messenger of Allah, peace be upon him, say: 'Their lives and property are like your lives and property.' So it is permissible for the treasurer to force the wealthy to give what he asks of them, and the treasurer is not obligated to pay it back, but to the creditors."
